Terms and Conditions

This contest (“Contest”) is organised by Singapore Press Holdings Foundation Limited (“Organiser”).
Participation in the Contest is subject to the Contests & Lucky Draws Terms and Conditions available at https://www.sph.com.sg/terms-and-conditions/online-contests/ (“General T&Cs”) and these Terms and Conditions herein (“Specific T&Cs”) (collectively “T&Cs”). In the event of any inconsistency between the Specific T&Cs and the General T&Cs, the Specific T&Cs shall prevail. Entry into this Contest shall be deemed acceptance of the T&Cs and any amendments, additions, replacements, variations and modifications hereto, which shall be final and binding in all respects on each participant. Amendments to the T&Cs will be posted at this webpage. By entering the Contest, participants unconditionally agree to be bound by and to comply with the T&Cs. Non-compliance with or breach of any of these T&Cs or any attempt to interfere with the Contest may disqualify a participant at any stage of the Contest, and any prizes won may be forfeited, withheld, withdrawn or reclaimed.
Employees of SPHF, Singapore Press Holdings Limited (“SPH”) and SPH’s related corporations (“SPH Group”) and their respective partners and/or sponsors for the Contest (if applicable), and such employees’ immediate family members (including spouses, children, parents, brothers and sisters) are not eligible to participate in the Contest. Winner(s) may be required to sign a written statement confirming their eligibility before prize collection.
Participant affirms the accuracy of all information provided at the time of Contest entry. Any misrepresentation of any fact or particulars (deemed material by the Organiser) shall result in disqualification and/or the forfeiture, withholding, withdrawal or reclaiming of any prizes won.
The Organiser reserves the right, at any time in its sole and absolute discretion, to substitute, withdraw, add to or alter any of the prizes offered without notice to the participants.
This contest is open to members of the public. To participate in this Contest, participants must upload a photograph (the “Photograph”) based on the theme “Exploring our Singapore” on their Instagram account with the hashtag #sphfphotocontest2021, and tag and follow @singaporepressholdings. The participant’s account must be set to permit public viewing of posts in order for the submission to be received. This Contest is in no way sponsored, endorsed or administered by, or otherwise associated with, Instagram. Participants understand that they are providing their information to the Organiser and not to Instagram.
By submitting an entry for the Contest, the participant represents and warrants that the Photograph is an original work created solely or owned by the participant. The participant further represents and warrants that the Photograph does not infringe on the copyright, trademark, moral rights, rights of privacy/publicity or any other intellectual property rights of any person or entity, and that no other party has any right, title, claim, or interest in the Photograph. Further, the participant agrees to indemnify the Organiser against any liabilities, losses, costs, charges and expenses incurred as a result of any claims, demands, actions and proceedings made or brought against the Organiser by any third party due to or arising out of the participant’s breach of any of the T&Cs.
Each participant may make up to five(5) submissions, but is only entitled to win a maximum of one prize in the Contest. Each submission is limited to one photograph and caption. Participants must be Singapore residents and at least 13 years old at the time of the submission of their entries.
The Contest runs from 12 July 2021, 0600 hours, to 22 August 2021, 2359 hours.
Winners of the Contest will be selected by the Organiser, in its sole and absolute discretion.
Winners of the Contest will be notified via Instagram Message and will be required to provide their email address and contact details. If a participant cannot be contacted or fails to respond within 3 days of the first notification, this participant will be disqualified and another winner will be selected. Winners will receive an email containing the details for the collection of their prizes.
Winners will each receive prizes as listed on https://sphfoundation.photonico.asia/. Prizes must be claimed personally by winners with proof of identification. In the event of any discrepancy between the entry submitted and the documents produced for verification, the entry will be deemed as disqualified and the prize forfeited. If any winner is unable to collect the prize personally, he or she may produce an authorisation letter (in the format acceptable to the Organiser) to authorise a proxy to collect on his or her behalf. Winners and authorised proxies are required to provide the appropriate identification documents for verification when collecting their prizes.
The Organiser’s decisions in relation to all aspects of the Contest are final and binding in all matters relating to the Contest. No enquiries or appeals, verbal or written, will be entertained. The participants shall unconditionally accept and abide by any and all decisions made by the Organiser concerning, without limitation, interpretation and application of the T&Cs, any other rules, procedures and regulations of the Contest, the award of prizes and any other matters relating to the Contest.
By making a submission for the Contest, each participant agrees that:
1. any and all personal data submitted or disclosed to the Organiser may be collected by, used by and/or disclosed to the Organiser and/or the SPH Group for various purposes, including to administer and publicise the Contest, to communicate with the participant for purposes related to the Contest, to provide goods and services to the participant upon request, and such other purposes that the Organiser and/or SPH Group may reasonably deem appropriate, or in relation to which the participant has otherwise provided the Organiser and/or SPH Group with consent;
2. the Organiser and/or SPH Group may collect, use, disclose and share the Photograph and participant’s personal data, including the Photograph or audio-video or other recordings of these participants submitted to the Organiser for the purpose of the Contest (collectively the “Material”) for publicity and/or use in advertisements across all media, including, without limitation, in SPH publications, presentations, promotional materials on their websites, in its original or edited format in the Organiser’s sole and absolute discretion, and whether to promote the Contest or otherwise without further notification, remuneration or compensation; and
3. the Participant is deemed to have granted the Organiser, free of remuneration or compensation, irrevocable, non-transferable, perpetual, non-exclusive rights to use and reproduce the Material for the Contest including anything necessary or incidental for the Contest.
The Organiser may, in its sole and absolute discretion, exhibit any of the entries through an online exhibition on https://sphfoundation.photonico.asia/ for such duration as it deems fit.
Participants shall not, without the prior written approval of the Organiser, speak to the press or any media nor give any interviews or comments relating to the Contest.
The Organiser, SPH Group and their respective partners and/or sponsors for the Contest (if applicable) shall not be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death in connection with the Contest, or any prize, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). If applicable, all warranty claims in regards to a prize shall be directed to the applicable manufacturer or provider of that prize. Except to the extent that they may not be excluded by law, no representations, warranties, terms or conditions that are not expressly stated in the T&Cs apply to the Contest or the prizes and all implied warranties are excluded, including but not limited to, the implied warranties of satisfactory quality, merchantability or fitness for a particular purpose of any of the prizes.
Prizes are not transferable or exchangeable and non-cash prizes cannot be exchanged for cash. Prizes are subject to availability and the Organiser has the right to substitute any prize for a comparable prize of equal or greater value to be awarded in lieu, subject to any applicable law.
Winners are responsible for arranging transport, delivery and insurance of their own prizes, and all taxes, charges, levies, fees and all other expenses or charges in relation thereto.
All prizes which are not won or remain unclaimed after one (1) month of the announcement of the winners will be forfeited.
The T&Cs shall be governed by and construed in accordance with the laws of the Republic of Singapore and each participant submits to the exclusive jurisdiction of the Singapore Courts.
